Effective Date: August 1, 2020

  1. Company: Celebration Brands Limited (CBL), the chief distribution company in Jamaica responsible for the sale and distribution of all Red Stripe/Diageo and Pepsi brands in Jamaica. As used in this agreement, “Celebration Brands”, “we”, “us” and “our” shall mean Celebration Brands Limited and its subsidiaries and affiliates.
  2. Terms & Conditions Applicability: Celebration Brands grants you permission to access its website in accordance with these Terms & Conditions. These Terms & Conditions shall apply to any order placed in person, over the phone or online. If, for any reason, you are not in agreement with all the terms and conditions outlined, kindly desist from using the site.
    • Persons under the age of 18 are prohibited from using the site.
  3. Minimum Order Value: The minimum value for orders to be delivered is J$4,000 (including General Consumption Tax). This is subject to change, without notice.
  4. Delivery zones: Deliveries are limited by zones. If your address does not fall within one of our zones, we will not be able to deliver your order. Whether your address falls within a particular zone is up to the sole discretion of Celebration Brands.
  5. Delivery charge: There is no extra charge for delivery orders that are above the Minimum Order Value. In cases where your Order Value is less than the Minimum Order Value, the difference between the two values will be charged as a Delivery cost.
  6. Online Registration: To order online, customers must register to do so by following the step-by-step registration process. Once registered, customers must first login by entering their email address followed by their password. Kindly note that Celebration Brands collects information provided, such as Customer Name, Delivery Address, Email Address and Telephone Number which may be used to communicate with the customer on advertising and marketing purposes or to contact a customer to verify the quality and/or quantity of goods and/ service provided. For more details on the collection and processing of information, please familiarize yourself with CBL’s Privacy Policy.
  7. Legal Competence: A customer must be legally competent to register. Any customer who is not legally competent who registers and places any order will not be entitled to returns or refunds. Furthermore, Celebration Brands will not be obliged to complete any order for a customer who is not legally competent.
  8. Correct entry of information: Customers are responsible for the correct entry and updating of their information for order completion.
  9. Payment options: Accepted payment methods for orders placed through the Celebration Brands website include Debit/Credit Cards Online, Cash on Delivery, and Credit/Debit Card on Delivery. This is subject to change.
  10. Product Availability: From time to time, some products may not be available for sale and Celebrations Brands or its affiliates are under no obligation to fill any order under such circumstances. Special offers, coupons and the like are not automatically applied and must be specifically selected by a customer when placing an order, if and when applicable. Where a customer does not take such action, the full price will be charged on a non-refundable basis.
  11. Maximum order limit: On a general basis, Celebration Brands limits any single order to 10 items HOWEVER Celebration Brands may further decrease this order limitation on an as-needed basis.
  12. Order Acceptance:
    • Celebration Brands is not obligated to accept any order.
    • In addition to (a) above, all orders for delivery are subject to the hours of operation of the Celebration Brands Distribution Centre or CBL affiliate designated to service the area to which the delivery is to be made. If a customer places an order that cannot be completed within the hours of operation CBL may refuse to accept the order.
    • Celebration Brands or its affiliates accept no liability for the refusal or non-acceptance of any order for any reason.
  13. Cancellations or Amendments by Customer: Any order placed and confirmed cannot be cancelled or amended. An order placed for future delivery may only be cancelled prior to eight (8) hours of the collection or delivery time. Any attempt to cancel or amend an order within one (8) hours of the delivery time cannot be accommodated.
  14. Cancellations by Celebration Brands: Where a situation arises whereby Celebration Brands or its affiliates cannot complete a delivery due to reasons beyond its control, Celebration Brands shall not be liable to complete and shall refund the customer for the order value. In this event, customer is not entitled to any compensation beyond refund in the value of the order.
  15. Website, Phone-line or Other Connectivity Issues: Celebration Brands shall not at any time be liable for difficulties and/or interruptions experienced by customers due to website, phone-line or other connectivity issues – this shall include delays in order completion.
  16. Order satisfaction: If you are not completely satisfied with your Celebration Brands experience, we will make it right or replace your product. Please consult the Celebration Brands ‘Refund Policy’. For the avoidance of all doubt – Celebration Brands does not issue cash refunds where the method of payment was not cash.
  17. Customer Responsibility: It is a customer’s sole responsibility to educate and familiarize themselves with Celebration Brands product offerings and make an informed decision on what they choose to order. Celebration Brands shall accept no responsibility for any food allergy or consumption related incidents. Where a customer is in doubt, please consult a Celebration Brands Service Compliance representative.
    • It is also a customer’s duty to familiarize themselves with all of Celebration Brands’ policies, including the Refund Policy and the Privacy Policy. All policies are linked and to be read as one.
  18. Amendment to Terms & Conditions: Celebration Brands may amend these Terms & Conditions at any time for any reason.
  19. Applicable Laws & Jurisdiction: Jamaica.
  20. Severability: Should any provisions of these Terms and Conditions prove to be unenforceable or invalid, the validity of the remaining provisions shall remain unaffected.
  21. Disclaimer: If Celebration Brands provides links to other services or entities (such as through advertising on the website), Celebration Brands is not responsible or liable for the content or privacy practices of these services or entities.
  22. Trademarks & Copyright:
    • All content included on this site, such as text, graphics, button icons, images and software, is the property of Celebration Brands and/or its parent companies Red Stripe/Diageo and Pepsi-Cola Jamaica Bottling Company Ltd. (PCJ) and is protected by international copyright laws. The content and software on this site may be used as either or both of an informational or shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on this site is strictly prohibited. Celebration Brands’ graphics, logos and trade names are trademarks of CBL and they may not be used in connection with any product or service that is not affiliated with and approved CBL in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Celebration Brands.
    • No person or entity shall use, or cause to be used, any trademark noted on the CBL’s website without the express written consent of the relevant trademark owner. This shall include trademarks related to Celebration Brands’, its partners and any paid advertisers.
  23. Fraud: Celebration Brands shall not at any time be liable for the fraudulent use of any Credit/Debit Cards by a Third Party to pay for orders on its website or otherwise. Where a customer believes that their Credit/Debit Cards have been so compromised, this must be reported immediately to the issuing bank.
  24. Criminal Acts: If a delivery driver is involved in any accident, incident or is the victim of criminal activity (or suspected criminal activity) whether directly or indirectly during the course of completing a delivery to any customer, it may be necessary for Celebration Brands to reveal certain information provided by a customer to facilitate the delivery to the relevant authorities. Celebration Brands will only share information specifically requested by the relevant authorities within the framework of its legal requirement to do so.

 

REFUND POLICY

Effective Date: August 1, 2020

  1. This Refund Policy (“Policy”) shall be read in accordance with the Celebration Brands Limited (CBL) Terms & Conditions.
  2. This Policy shall govern any order placed through CBL, through any method of ordering available at the time.
  3. Any customer who receives an incorrect or damaged order may contact CBL and request:
    • The correct order be completed; or
    • A refund in the amount or value of the order placed.
  4. A customer must contact the CBL channel through which the order was processed
    • during its hours of operation and
    • within 24 hours of the order being delivered to complete the action at (3) above.
  5. CBL may issue a cash refund only where the method of payment in the first instance was made in cash. CBL only accepts Visa and Mastercard debit and credit cards and any relevant refund can only be processed through a Visa or Mastercard debit or credit card.
  6. Refunds may take up to seven (7) business days to complete. If a customer has not received their refund within this time, they should make contact with CBL.
